Marie Callender’s Salmonella Outbreak Lawsuits

On June 23, 2010, Marler Clark filed the first lawsuit against ConAgra on behalf of a Happy Valley, Oregon man who was infected with Salmonella after eating Marie Callender’s brand Frozen Cheesy Chicken and Rice dinners. A second lawsuit was filed on June 25 on behalf of another Oregon victim in the nationwide outbreak. Both claims have been resolved.

A recall of Marie Callender’s Frozen Cheesy Chicken and Rice dinners was announced on June 17, 2010 after ConAgra was informed by the U.S. Centers for Disease Control and Prevention (CDC) of an investigation involving 30 people in 15 states who had been diagnosed with Salmonella Chester. The actual number of victims in this outbreak, however, is likely much larger than 30. The CDC estimates that in Salmonella outbreaks, the actual number of victims is as many as 38 times the number of confirmed cases.

As of June 25 2010, the number of ill people identified in this outbreak in each state was as follows: AK (1), CA (5), CO (2), GA (7), IL (1), KY (1), MA (2), MN (2), MO (1), NC (1), OK (1), OR (2), SC (2), TN (1), TX (1), UT (2), VA (4), Among those for whom information is available about when symptoms started, illnesses began between April 5, 2010 and June 3, 2010.
